r/Maliciouscompliance My Stupid Boss VS The United States Military

r/Maliciouscompliance OP is enlisted in the military, and he also works a normal 9-5 job. He gets orders to appear for a training drill, so he informs his boss. Like an absolute idiot, OP's boss tries to tell him that coming into work is more important than showing up for military duty, so OP will be fired if he skips work. Well, turns out that violating an active soldier's rights is a pretty big deal in the eyes of the US military. After OP makes just one phone call, the manager is stumbling over himself trying to apologize to OP.

  • The ice cream thing.. Usually a bigger container is cheaper overall. Like a pint might be $2 and a half gallon night be $3.5.. so 2 pints are more money for the business then one half gallon despite being the same size. You can check in and grocery store (or online), that's how businesses work everywhere.

  • Years ago I was a mobilized reservist. I was called up in 2003 for Iraq. At the end of our mobilization I agreed to stay on for another year. The rest of my unit went back to their civilian lives. We had a few Soldiers who lost their jobs while mobilized. Mostly it was where an employer had closed down so there's not much that can be done. They knew well ahead of time and had found new jobs to go to. One had a really shitty employer who refused to let him come back to work. His position was still there, just someone else was doing the job. Our CO and 1SG Called his employer and tried to talk some sense into them but it was not sinking in so off he went to JAG. While JAG cannot represent you, they can steer you to a appropriate attorney who can. Long story short, he never did get his job back but he did get a very hefty settlement.

  • The Uniformed Services Employment and Reemployment Rights Act requires the employer to give unpaid time off for military duties and reinstatement in the same or equivalent pay and promotion position. The Department of Labor is the enforcing agency and federal courts aren't tolerant of violations of the USERRA. Suffice it to say, that mismanager came dangerously close to placing the company, owner and himself subject to enforcement actions that would've left them yearning for a good pee-pee smack with a sledgehammer. Ordered reinstatement, pay from the effective return from duty, injunctions, contempt of court and more. Things would get real expensive, really, really quickly. www.justice.gov/crt-military/userra-statute

  • Re: the ice cream story. You're right about how a business *owner* would see that situation. The problem is, the kid running the register most likely has no connection at all to the owner. And most customer-facing jobs prefer people who don't think up their own solutions too much. They want someone who follows orders. For the guy himself, he doesn't care how much the ice cream shop makes, he gets paid the same either way. Also very often in chains or franchises, there are stupid rules set up that you cannot change and will get in trouble for trying to bypass. Added all together, it leads to an apathetic front counter guy who doesn't give a shit what you want and has more to gain by making you leave than by selling you something (though not if you kick up enough fuss that the fastest way to get rid of you is to give you what you want). All this adds up to a REALLY BAD SYSTEM that breeds the kind of people who yell at servers because they know that's the quickest way to get whatever they want. Even though I have no plans to become an entrepreneur, I sometimes think about problems like this and wonder if there is a systematic way to fix them in a large organization. I think one thing I would do if I owned a shop is have a policy of throwing out people who swear at any of my employees. Refusing to throw out people who yell, scream and curse makes your shop worse for everybody, not just your workers. Polite customers don't want to witness that stuff either! Now as to how to make frontline workers care and treat your customers better is probably as easy as paying them more and giving them benefits. But it's more subtle than that, because one tyrant manager can completely destroy your employee's morale so that no matter what you pay them they still don't care. That's the unsolvable problem, how to always have good management so your frontline people are happy. It'll always mean constant work and attention by the people at the top to make sure managers like that are weeded out.

If you are selling something for $1.75, or 3 for $5.25, you'd be amazed how many people buy 3 of them, even though the price is the same. (You'll probably hear a lot of "They're $1.75 each, but if we buy 3 it's only $5.25". Really, they don't get it's the same price per item!)

  • Hey rSlash, You made a comment about setting your business up to allow the customer to spend the most money possible. So true BUT, the ice cream shop scenario doesn’t work the way you think. It often times costs a company more to stock things such as additional gallons etc. also there are generally regulations in place (in the us at least ) which prevents the filling of a container that large from a scoopable bucket. (I learned that as I currently work as a manager in a ice cream shoppe). The owner of the company did set the company up to let the customer spend the most money possible, it seemed more like the employee was not either trained properly to recognize a potential sale and assist a customer or they were a complete idiot.

Obviously you haven't been to convenience stores, drive ins, fast food places, anywhere that the register doesn't automatically kick out the change, not ALL but a whole bunch for sure, do not or cannot figure out correct change. • The reason why the gas station people don't want money is because it's not directly their money, unless they own the place. Many people in service jobs simply don't care enough to do much more than the absolute minimum, since it doesn't affect their paycheck unless it becomes so bad that the store goes out of business. I do agree though, it kinda hurts my soul a bit

  • Had a similar issue with my current job which is a state level job giving me issues about my military obligations. I work nights shifts so they either have to let you switch to day shifts for that week or you put in your own admin day for the night before. (If it starts Friday and I work Thursday night you technically can't get Thursday night off since it's not covered under the DoD days) I emailed my schedule the week I got there and gave them a physical paper in the mailbox as well as sent 2 emails about switching to days for my upcoming drill. They denied me. For the time being I used my Admin day and waited for the meeting with the Union reps that they do every quarter which was a week or two after that. I explained to the head of it what happened and he said that it was against their policy as well as it did trample over my military day. The boss of the company and that representative had a very nice talk about getting denied one of their opinions for my military duties. Better yet I would have involved my Sgt and had my job explain to them why I wouldn't be there when I told them about my conflict. I work in an MP company so you KNOW that's not gonna roll over well.
